On 25 July 2022, China’s Supreme People’s Court (SPC) issued the “Opinions on Providing Judicial Services and Guarantees for Accelerating the Construction of the National Unified Market” (关于为加快建设全国统一大市场提供司法服务和保障的意见, hereinafter referred to as the “Opinions”).
China issued the “Opinions on Accelerating the Construction of the Unified National Market”(关于加快建设全国统一大市场的意见) in April 2022, which stresses the normative value and safeguards that the rule of law provides in the development of the unified national market.
On this basis, the Opinions issued by the SPC requires to strengthen the judicial regulation of Internet platform monopoly, to stop promptly the use of data, algorithms, technologies and other means to exclude or restrict competition, and to issue judicial interpretations of anti-trust civil actions in due course.
The Opinions clarifies that the SPC will explore the publication of guiding cases involving foreign civil and commercial matters in multiple languages, so as to expand the international influence and credibility of Chinese judgments.
