Personal injury claims farming (Queensland).

With thanks to Rob Davis for drawing attention to the Personal Injuries Proceedings and Other Legislation Amendment Act 2022 (QLD), assented to on 30 June 2022.

The effect of the rather complex amendments is briefly summarised in a document made available by the Queensland Bar Association here. The document states:

The legislative amendments include new offence provisions prohibiting claim farming practices including giving or receiving consideration for referring a claimant or potential claimant, and personally approaching or contacting another person to solicit or induce them to make a claim.

The concept of a personal approach or contact is set out in section 71B. It extends to electronic communication and applies whether the person is contacted individually or as a member of a class of persons.

A media statement by the Attorney General on 22 June 2022 makes express reference to claims involving institutional child abuse, where the approach is by a person who will receive a payment for a referral.
