Napoli Shkolnik, one of the nation’s leading mass tort and plaintiff class-action law firms, has filed a federal class-action suit against Carvana in the Western District of North Carolina, Statesville Division, as of November 18, 2022. This action is being brought on behalf of both State and National proposed classes of duly licensed used-car dealers who have been damaged as market competitors by Carvana’s false advertising and unlawful business practices.
By engaging in a pattern of unfair and deceptive trade practices—including false advertising, Carvana has gained an unlawful advantage in the market share of used car sales in North Carolina and across the nation, adversely affecting competitors, including Plaintiff and Class Members, as well as consumers,” said Napoli Shkolnik Partner Salvatore C. Badala, who along with the firm’s North Carolina Associate, Nevin Wisnoski, is leading the legal team in this matter.
“Legitimate used-car dealers in North Carolina and across the country have suffered direct financial and competitive harm due to an inability to lawfully compete with Carvana’s illicitly obtained market advantages—which hurt both market competitors and the broader consuming public,” said Nevin Wisnoski, who signed the filed complaint.
