Remember those posters you are supposed to have in your physical offices?
Well the EEOC yesterday just released a new one that is sure to make all those companies that offer those posters (at a charge, instead of for free) happy.
As of this morning, the link to the actual poster remains broken on the EEOC website, but other lawyers have downloaded it.
The substance of the poster doesn’t change all that much though a QR code has been added so that employees can directly file a complaint using that code.
The EEOC, in a press release, notes that the new poster:
- Uses straightforward language and formatting;
- Notes that harassment is a prohibited form of discrimination;
- Clarifies that sex discrimination includes discrimination based on pregnancy and related conditions, sexual orientation, or gender identity;
- Adds a QR code for fast digital access to the how to file a charge webpage;
- Provides information about equal pay discrimination for federal contractors.
The EEOC doesn’t indicate when this poster should be used — other than to say that it should be used. As a practical matter, many employers update their posters yearly and should make sure that this gets added to the mix.
