Abuse: Mental harm from abuse of daughter (Limitation issues).

AB v State of Queensland & Anor [2022] QCA 109 (on JADE).

This was an appellate reconsideration of a limitation period issue, which saw the Court make an order extending the limitation period for the appellant’s personal injury claim.

It is mentioned here as the underlying claim is one where the appellant had been been diagnosed by psychiatrists as suffering from a generalised Anxiety Disorder, a secondary Major Depressive Disorder and an Adjustment Disorder with features of Post Traumatic Stress Disorder, as a result of a significant psychological shock from the abuse of her daughter by a 17 year old boy who had been allocated to her for foster care.

Her primary action claims damages for personal injury and consequential loss against LWB and the State of Queensland which administered a foster parent scheme.
